CONSUMER RIGHTS – RIGHT OF WITHDRAWAL – CANCELLATION AND REFUND TERMS

GENERAL:

By placing an order electronically via this website, you are deemed to have accepted the preliminary information form and the distance sales contract presented to you.

Buyers are subject to the provisions of the Law on the Protection of Consumers No. 6502, the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188), and other applicable laws regarding the sale and delivery of the purchased products.

Shipping costs associated with the delivery of the product shall be paid by the buyers.

Each purchased product shall be delivered to the person and/or organization at the address specified by the buyer, provided that the delivery does not exceed the statutory period of 30 days. If the product is not delivered within this period, the Buyer may terminate the contract.

The purchased product must be delivered complete, in accordance with the specifications stated in the order, and accompanied by any relevant documents such as a warranty certificate and user manual.

In the event that the sale of the purchased product becomes impossible, the seller must notify the buyer in writing within 3 days of becoming aware of this situation. The total amount paid must be refunded to the Buyer within 14 days.

IF THE PRICE OF THE PURCHASED PRODUCT IS NOT PAID:

If the Buyer fails to pay the price of the purchased product or cancels the payment in bank records, the Seller's obligation to deliver the product ceases. PURCHASES MADE VIA UNAUTHORIZED CREDIT CARD USE:

If, following the delivery of the product, it is determined that the credit card used for payment was utilized unlawfully by unauthorized persons and the price of the sold product is not paid to the Seller by the relevant bank or financial institution, the Buyer is obliged to return the product subject to the contract to the Seller within 3 days, with shipping costs borne by the Seller.

FAILURE TO DELIVER THE PRODUCT ON TIME DUE TO UNFORESEEN CIRCUMSTANCES:

If force majeure events beyond the Seller's control occur and the product cannot be delivered on time, the Buyer shall be notified of the situation. The Buyer may request the cancellation of the order, the replacement of the product with a similar one, or the postponement of delivery until the impediment is removed. If the Buyer cancels the order and made the payment in cash, the amount shall be refunded in cash within 14 days of the cancellation. If the Buyer made the payment via credit card and cancels the order, the product price shall be refunded to the bank within 14 days of the cancellation; however, the bank may take 2–3 weeks to transfer the funds to the Buyer's account.

BUYER'S OBLIGATION TO INSPECT THE PRODUCT:

The Buyer shall inspect the goods/services subject to the contract before taking delivery; the Buyer shall not accept delivery from the shipping company of any goods/services that are damaged or defective (e.g., dented, broken, torn packaging). The goods/services accepted upon delivery shall be deemed to be undamaged and intact. The Buyer is obliged to carefully protect the goods/services after delivery. If the right of withdrawal is to be exercised, the goods/services must not be used. The invoice must also be returned along with the product. RIGHT OF WITHDRAWAL:

The BUYER may exercise the right to withdraw from the contract by rejecting the goods—without assuming any legal or criminal liability and without providing any justification—provided that they notify the SELLER via the contact details below within 14 (fourteen) days from the date of delivery of the purchased product to themselves or to the person/organization at the address they have designated.

DURATION OF THE RIGHT OF WITHDRAWAL:

If the purchase concerns a service, this 14-day period commences on the date the contract is signed. The right of withdrawal cannot be exercised in service contracts where the performance of the service has begun with the consumer's approval before the withdrawal period has expired.

Costs arising from the exercise of the right of withdrawal shall be borne by the SELLER.

To exercise the right of withdrawal, it is mandatory to provide written notification to the SELLER via registered mail with return receipt, fax, or e-mail within the 14 (fourteen) day period, and the product must not have been used, in accordance with the provisions regarding "Products for Which the Right of Withdrawal Cannot Be Exercised" set forth in this contract.

EXERCISE OF THE RIGHT OF WITHDRAWAL:

The invoice for the product delivered to the 3rd party or the BUYER (if the invoice for the product to be returned is issued to a corporate entity, it must be sent together with a return invoice issued by that entity upon return; returns of orders invoiced to corporate entities cannot be completed unless a RETURN INVOICE is issued).

The return form; the products to be returned must be delivered complete and undamaged, together with their boxes, packaging, and any standard accessories. RETURN CONDITIONS:

The SELLER is obliged to return the total amount paid and any documents binding the BUYER to the BUYER within a maximum of 10 days from the receipt of the notice of withdrawal, and to accept the return of the goods within 20 days.

If there is a decrease in the value of the goods due to a reason attributable to the BUYER, or if the return becomes impossible, the BUYER is obliged to compensate the SELLER for the damages in proportion to their fault. However, the BUYER is not liable for any changes or deterioration resulting from the proper use of the goods or product within the withdrawal period. If the use of the right [of withdrawal] causes the total purchase amount to fall below the threshold set for a campaign organized by the SELLER, the discount amount obtained under that campaign shall be cancelled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:

Items prepared in accordance with the BUYER’s requests or clearly for their personal needs and which are unsuitable for return; underwear bottoms, swimsuit and bikini bottoms, makeup products, disposable products, goods at risk of rapid deterioration or expiration; products unsuitable for return due to health and hygiene reasons if their packaging has been opened by the BUYER after delivery; products that become mixed with other items after delivery and cannot be separated due to their nature; goods related to periodicals such as newspapers and magazines (except those provided under a subscription agreement); services performed instantly in an electronic environment or intangible goods delivered instantly to the consumer; and—pursuant to the Regulation—audio or video recordings, books, digital content, software programs, data recording and storage devices, computer consumables, and items where the packaging has been opened by the BUYER. Furthermore, pursuant to the Regulation, the right of withdrawal cannot be exercised for services where performance has begun with the consumer's consent before the withdrawal period has expired.

To be eligible for return, cosmetics and personal care products, underwear, swimsuits, bikinis, books, copyable software and programs, DVDs, VCDs, CDs, and cassettes, as well as stationery consumables (toner, cartridges, ribbons, etc.), must have their packaging unopened and must be untried, undamaged, and unused. DEFAULT AND LEGAL CONSEQUENCES

In the event that the BUYER defaults while making a payment via credit card, the BUYER accepts, declares, and undertakes to pay interest and be held liable to the card-issuing bank in accordance with the credit card agreement existing between them. In such a case, the relevant bank may resort to legal remedies and demand payment of incurred expenses and attorney fees from the BUYER; furthermore, should the BUYER default on the debt, the BUYER agrees to compensate the SELLER for any damages and losses suffered due to the delayed performance of the obligation.
